Wife sues in man's hotel death

The wife of a California man who died July 6 following a scuffle at the Hyatt Regency Waikīkī Resort and Spa has sued the hotel, ABC Stores, and a number of individuals.

Humberto Murillo, 33, who was vacationing with his family, died following a confrontation in the hotel's second-floor shopping area after he allegedly took two 12-packs of beer without paying for them from an ABC Store in the hotel.

Murillo died after a struggle with the store manager and a tourist who came to the manager's aid.

Sabrina Medina of San Fernando, Calif., listed in the lawsuit as the wife of Murillo and the mother of his three children, is seeking unspecified damages from the hotel, two of its security personnel, the ABC store, its manager, the tourist who intervened on the manager's behalf and other unnamed individuals and organizations for illegally causing Murillo's death.

According to police investigators, witnesses said the store manager caught up with Murillo in the hotel and asked to see a receipt for the beer.

Murillo allegedly hit the manager with one of the 12-packs and then began "pummeling him." When the manager cried for help, the tourist moved in and subdued Murillo, police said.

As he was being held down, Murillo lost consciousness. It was unclear if hotel security arrived at the scene before or after Murillo lost consciousness. Paramedics later arrived and took Murillo to the hospital where he was pronounced dead.

An autopsy performed by the Honolulu Medical Examiner's Office listed the cause of Murillo's death as asphyxia, and concluded that the manner of death was homicide. Toxicology reports showed that Murillo tested positive for marijuana and negative for alcohol.

Officials at the Hyatt Regency and ABC Stores would not comment on the lawsuit yesterday.
