HILO — A Wainaku man accused of raping and drowning a 5-year-old girl Sunday made his initial court appearance yesterday afternoon.
Hilo District Judge Barbara Takase set a preliminary hearing date of 1:30 p.m. tomorrow for Anthony Serges Poulin.
Poulin, 30, is charged with second-degree murder, two counts of first-degree sex assault plus abuse of a family/household member in the death of Javieanne Win. He is being held on $1 million bail.
Poulin, who wore a dark blue pocket T-shirt, torn jean shorts and black rubber slippers when he was arrested Sunday, was wearing ill-fitting blue surgical scrubs and shackles when he was escorted into the courtroom by sheriff's deputies for his brief appearance. He remained silent the entire time.
Numerous family members and neighbors of Win, a first-grader at Chiefess Kapiolani Elementary School, were at the proceedings, including her mother, Jennifer Abiley, who declined to be interviewed.
Abiley was not at home and Win was in Poulin's care when police and paramedics responded to a 3:06 p.m. call of an unresponsive child in a filled bathtub in the family's Puueo Street apartment. Win was taken by ambulance to Hilo Medical Center where she died at 4:28 p.m.
An autopsy found that Win's death was a homicide by "asphyxiation due to forceful submersion," said police Capt. Randall Medeiros, head of the Criminal Investigations Section.
"She was a good girl," said Win's grand aunt, Adeline Makuakane. "She was so loving and so respectful. She called everybody her aunty and uncle. She would say, 'Hi, Uncle' and 'Hi, Aunty.' She was well-liked. She had such a beautiful smile."
Though tears, Makuakane said the family was already grieving due to the July 23 death of her mother, also named Adeline Makuakane, who was Win's great-grandmother. She said Win attended the funeral.
"She handled (it) like a little princess," Makuakane said. "She knew that her great-grandma went to be with the Lord and with her great-granddad."
Less than 40 minutes before emergency personnel went to the apartment, police received a call about a man abusing a girl at Shipman Street and Kamehameha Avenue in downtown Hilo.
A court affidavit written by police Detective Reed Mahuna said a woman "reported witnessing Poulin grab the victim by the hair, spin her around and slam her violently into the cement side of a building face first."
Surveillance video from Alert Alarm of Hawaii caught the girl shortly before the attack. The video, which was turned over to police, shows the girl walking back and forth on the sidewalk in front of businesses at Shipman and Kamehameha, less than two hours before her death.
The affidavit also said that a neighbor may have heard the girl's final moments. The neighbor told police that "she heard the victim scream once from the victim's bathroom, then heard a 'clunk,' then the suspect talking loudly."
The affidavit referred to a report by Merle Endo, a registered nurse and sexual assault forensic examiner, detailing acute injuries to the girl's body that Endo concluded were consistent with "blunt force trauma during non-consensual sexual penetration."
According to a domestic violence statement filed by Officer Robert Pule Jr., Win suffered "injuries to her entire body including a fractured arm."
Said Makuakane: "I don't know how someone could do this to anyone."
Makuakane said the family is accepting donations for Win's burial expenses. She asked that contributions be mailed or dropped off to IEG Federal Credit Union, 375 Kekuanaoa St. in Hilo with a notation "on behalf of Javieanne Win."
