A 23-year-old man who was shot by police Tuesday in Waikele after he allegedly drove a stolen SUV at two police officers faced stolen-vehicle and refusal-to-stop charges in 2004, state court records show.

Jeremiah Lopez III was shot twice in the stomach and once in the arm Tuesday after he tried to bash his way out of the drive-through lane at the Waikele KFC restaurant, where the stolen Dodge Durango he was driving had been cornered by police officers.

He remained at The Queen's Medical Center yesterday, where his condition was improving, police said.

Lopez was arrested shortly after the 12:25 p.m. Tuesday incident on suspicion of two counts of attempted first-degree murder and one count of unlawful entry into a motor vehicle.

State court records show that five years ago, Lopez pleaded no contest to charges of unauthorized control of a vehicle, a felony, and several misdemeanor or petty misdemeanor charges including leaving the scene of an accident involving property damage or injury, driving without a license and resisting a police officer's order to stop.

The 2004 case centered on a stolen motorcycle .

After pleading no contest to the charges against him, Lopez asked for and was granted a deferred acceptance of no-contest plea and was ordered to comply with conditions similar to probation.

Lopez applied for early termination of his probation in the case, and that request was granted in June 2008.

As a result, his official criminal record does not list the 2004 stolen-vehicle case or the resisting-an-order charge.

When he was arrested after the incident on Tuesday, Lopez used an address on Lahaina Street in Mäkaha, but later told police he had been living in Wahiawä.

Two people who were in the Durango during Tuesday's incident also were arrested.

Cherish Craig, 25, was booked on suspicion of assaulting a police officer and unlawful entry into a vehicle.

Ronald Kalani-Pawai, 25, was booked on suspicion of unlawful entry into a vehicle and a contempt-of-court charge from an unrelated case.

Craig and Kalani-Pawai denied having permanent local addresses. But police yesterday said they believe Craig has lived most recently in the Waianae area and that Kalani-Pawai is from Kapolei.
