MIAMI — Cleveland Browns wide receiver Donte Stallworth was charged yesterday with killing a pedestrian last month while driving drunk after a night out at a swank South Beach nightspot.

An arrest warrant charging Stallworth, 28, with DUI manslaughter was filed in the March 14 accident that killed 59-year-old Mario Reyes. If convicted, Stallworth would face as many as 15 years in prison.

Stallworth's blood-alcohol level after the crash was .126, well above Florida's legal limit of .08, according to results of a blood test. Stallworth will also be charged with DUI, which carries a possible six-month sentence plus fines and community service for first offenders.

Stallworth is expected to surrender in court today. Prosecutors said they will ask that he be released on $200,000 bail.

The Browns said in a statement that they are "disappointed" that Stallworth has put himself in this position.

COP IN MOATS' CASE RESIGNS

The police officer who pulled out his gun and threatened Houston Texans running back Ryan Moats with jail instead of allowing him inside a hospital where his mother-in-law was dying resigned yesterday.

Officer Robert Powell had been placed on paid leave pending an investigation of the March 18 incident.

"I made this decision in the hope that my resignation will allow the Dallas Police Department, my fellow officers and the citizens of Dallas to better reflect on this experience, learn from the mistakes made, and move forward," Powell said in a statement issued through his attorneys.

RECEIVER BRUCE WILL RETURN

Receiver Isaac Bruce is postponing retirement for another season with the San Francisco 49ers.

Bruce, the second-leading receiver in NFL history with 14,944 yards, informed coach Mike Singletary yesterday of his decision to return for his 16th NFL season.

He missed the 49ers' minicamp last month while contemplating retirement, but his return is a major boost to a San Francisco offense that would have lacked a top receiver. Bruce led San Francisco with 61 catches for 835 yards and seven touchdowns last season, his first with the 49ers after 14 seasons with the Rams.

Bruce hit two major milestones during a late-season win over St. Louis, passing Tim Brown for the second-most receiving yards in league history and becoming the fifth player to catch 1,000 passes.
